Introduction

This Content Provider Agreement ("Agreement") is entered into between Fap Roulette ("Platform") and its content providers ("Creator"). This Agreement outlines the terms and conditions for the submission and use of content provided by the Creator to the Platform.

Definitions

• - "Creator" refers to Content Providers on our website who create roulettes and submit content to the Platform.

• - "Platform" refers to Fap Roulette, accessible through our website https://faproulette.co.

• - "Content" refers to all forms of media submitted by the Creators, including but not limited to images, videos, text, and music.

Content Submission Guidelines

Creators must meet our guidelines and are strictly prohibited from submitting any copyrighted content without explicit permission. These guidelines are regularly reviewed and updated to adapt to new legal requirements and industry standards.

Prohibition of Copyrighted Content

Users are strictly prohibited from uploading any copyrighted content that they do not own or do not have explicit permission to use. This includes, but is not limited to, images, videos, music, and text. All Creators are required to use images that are free of copyright restrictions for their roulettes.

Content Recognition Technology

We have implemented a content recognition system combined with manual moderation to identify copyrighted materials. This system is updated and audited biannually to ensure its accuracy and effectiveness in identifying copyrighted materials. Our team of moderators works alongside the detection system to review flagged content and take appropriate actions according to the rights holder’s preferences.

User Education and Tools

We provide extensive resources and tools for our users to understand copyright laws and ensure their content complies with relevant regulations. This includes guidelines on fair use and fair dealing principles, and we offer interactive tools and regular webinars to help creators understand these laws.

Proper Attribution

We respect the moral rights of content Creators by providing proper attribution. We use automated systems to ensure proper attribution, including the addition of watermarks and credits to acknowledge original creators.

Licensing and Permissions

For content that does not clearly fall under the public domain or is not free of copyright restrictions, we obtain the necessary licenses or permissions from the rights holders. We follow a stringent verification process to obtain and validate these licenses before using the content on our platform.

Warranties and Representations

The Creators warrant that they own all rights to the content and that the content does not infringe on any third-party rights. Creators also affirm that the jurisdiction from which they access the Platform does not prohibit the receiving or viewing of sexually explicit content.

Handling Infringement Claims

We have a robust process for handling copyright infringement claims. If a rights holder believes their content has been used improperly, they can contact us, and we will promptly investigate and resolve the issue, which may include removing the content or obtaining proper permissions. All infringement claims are resolved within 24 hours.

Content Review Process

All submitted content will be reviewed by our moderation team to ensure compliance with our guidelines and policies. Content that violates these guidelines will be rejected, and the Creators will be notified. Our moderation staff undergoes thorough training sessions biannually to stay updated on the latest policies and review techniques.

Penalties for Violation

Creators who violate these guidelines may face penalties, including content removal, account suspension, or termination. Repeated violations may result in a permanent ban from the Platform. Penalties for violations are consistent with our platform’s guidelines and relevant legal requirements, ensuring fair and lawful enforcement.

Dispute Resolution

Any disputes arising under this Agreement shall be resolved through binding arbitration in accordance with the rules of the Netherlands Arbitration Institute (NAI). For international disputes, the parties agree to submit to the jurisdiction of the International Chamber of Commerce (ICC) International Court of Arbitration.

Data Protection and Privacy

We comply with international data protection laws, including the GDPR for European users. Creators must ensure that their content does not violate the privacy rights of any individuals. We use advanced encryption methods and robust data protection measures to safeguard users' personal information.

Age Restrictions and Prohibited Content

Creators must affirm that they are at least 18 years of age or the age of majority in the jurisdiction they are accessing the Platform from. Additionally, the following types of content are strictly prohibited on our Platform:

• - Content depicting any person under 18 years of age.

• - Content depicting bestiality, child pornography, rape (or any other non-consensual sexual behavior), snuff, torture, death, extreme violence, or incest.

• - Content containing falsehoods or misrepresentations that could damage the Platform or any third party.

• - Content that is obscene, illegal, unlawful, defamatory, libelous, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate.

Agreement to Terms

By uploading content to Fap Roulette, the Creator agrees to the terms outlined in this Agreement.

Updates to the Agreement

This Agreement may be updated from time to time. Creators will be notified of any changes, and continued use of the Platform following any updates constitutes acceptance of the new terms.

Limitation of Liability

To the fullest extent permitted by law, the Platform shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• - Your access to or use of or inability to access or use the Platform;

• - Any conduct or content of any third party on the Platform, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties;

• - Any content obtained from the Platform; and

• - Unauthorized access, use, or alteration of your transmissions or content.

In no event shall the total liability of the Platform for all claims related to the service exceed the greater of one hundred U.S. dollars (US $100.00) or the amount you paid the Platform, if any, in the last 12 months for the services.

Indemnification

Creators agree to indemnify, defend, and hold harmless the Platform, its officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with the content they upload or their use of the Platform.

Termination

This Agreement is effective until terminated by either party. Creators may terminate this Agreement at any time by discontinuing use of the Platform and removing their content. The Platform may terminate this Agreement at any time for any reason, with or without notice.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any disputes arising under or in connection with this Agreement shall be resolved in the courts of Amsterdam, Netherlands.
